Why contractor → PAYE changes the insurance ask

Contractors you engage as self-employed are generally not your employees for EL purposes. The moment someone becomes your employee (PAYE, even part-time or fixed-term), employers’ liability becomes a legal requirement in Great Britain for almost all employers. Clients, coworking spaces, and enterprise MSAs often ask for the EL certificate as soon as headcount is on payroll — not weeks later.

Typical timing for UK startups

  1. Founders only / contractors only — EL may not yet apply; contractor / PI / PL packs often dominate

  2. Decision to hire or convert — check contracts, IR35 / employment status advice (legal, not insurance), and tell the broker the planned start date

  3. Before first PAYE day — bind EL so cover is live on day one of employment; request the certificate in the same placement

  4. First payroll run — keep the EL certificate with HR / ops; many clients ask for it in onboarding packs

FAQs

Do UK startups need employers’ liability when converting contractors to PAYE?

Yes in almost all cases once someone is your employee in Great Britain. EL is a legal duty for employers; the certificate is what clients and spaces usually ask to see. See Employers’ Liability Insurance UK for the product job.

When should the EL certificate be in place?

On or before the first day of employment / first PAYE day — not after the first payslip. Build in broker placement time.

What about people who stay as contractors?
